Which part applies to you

These Terms have three parts. Sections 1 to 22 apply to everyone. After them come two annexes, and exactly one of them applies to you, depending on where you live — not on which version of this page you happened to open.

  • Part A applies if you live in the European Union or the European Economic Area. It sets out German law as the governing law and describes your consumer rights.
  • Part B applies if you live anywhere else. It sets out Delaware law, arbitration and a class action waiver.

If Part A applies to you, nothing in Part B applies — including the arbitration agreement, the class action waiver and the jury trial waiver. If Part B applies to you, nothing in Part A applies.

Where a section in the main body and the annex that applies to you say different things, the annex wins.

1

Acceptance

By downloading, installing or using the Cibe app, you agree to these Terms. They form a binding agreement between you and Intevion, Inc. If you do not agree, do not use the app.

You accept these Terms during registration by ticking the box next to "I agree to Cibe's Terms of Use and take note of the Privacy Policy". The contract comes into effect when we activate your registration.

We may update these Terms. How that works, and what notice you get, is in section 21 and — if you are in the EU or EEA — in Part A.

2

Definitions

  • App — our mobile application, available in the Apple App Store and Google Play Store (each an "App Store").
  • Website — https://cibe.app.
  • Company, we, us, our — Intevion, Inc.
  • You, your, Customer — the user of the free or paid Services.
  • Consumer — a natural person entering into this contract for purposes largely outside their trade, business or profession.
  • Services — the App and its features, in their current version.
  • Customer Content — person profiles, notes, feedback, chat history and other information you submit.
  • Output — text generated by the AI features from photos, profile information and your prompts.
  • Circle — the set of person profiles you create in the App.
3

Eligibility and Accounts

Age

Cibe is for adults only. You must be at least 18, or older if your country sets a higher age of majority. By using the Services you confirm that you meet this requirement.

Registration

You register by linking your Google or Apple account; we do not offer username-and-password sign-up. The terms and privacy policies of Google or Apple apply to that step. You may optionally add a description of yourself.

Invitations and waitlist

Access may depend on invitation codes, capacity or a waitlist. We do not guarantee that registration is open at any given time. Where offered, you may join a waitlist and enable notifications about future access.

Account security

You are responsible for what happens through your account, and for securing the Google or Apple account you use to reach it. If you notice unauthorised access or misuse, tell us immediately using the details in our Legal Notice. Do not use photos, names or other personal data in your profile if that would infringe someone else's rights.

4

The Service

Cibe lets you:

  • create an account;
  • create profiles of people by submitting photos and adding a name, notes and context;
  • use AI features that generate non-binding, positive or neutral observations and communication suggestions from those photos, your profile information and your prompts;
  • give feedback and ratings, and switch personalisation on or off;
  • see your profiles in the My Circle area and open the connected chat history;
  • add, edit, delete and manage your content — profiles you delete stay in a "Recently Deleted" folder on your device for 30 days so you can restore them;
  • share selected profiles or invitation codes through the sharing functions, subject to section 10.

We grant you a personal, non-exclusive, non-transferable right to use the Services for the term of this contract. That right ends when the contract ends.

Parts of the Services may use open-source components under their own licence terms, which prevail over these Terms in case of conflict.

5

Photo Rights and Your Responsibilities

Before submitting a photo or other personal data of another person, you must confirm that you have the necessary rights, permissions, consents or other legal basis for that upload and for the processing through the Services. If we ask, you must be able to show reasonable evidence of it.

We record each confirmation you give, together with the time and the version of these Terms it referred to. Details are in the Privacy Policy.

You must not submit, upload or analyse photos or other personal data of anyone under 18, and you must not create or share profiles of such persons.

You are solely responsible for the content you submit. Avoid putting unnecessary personal data, and any highly sensitive information, into chats or AI features.

If we reasonably believe you lack the necessary rights or legal basis, or that your content or use breaches these Terms, we may remove the content or restrict or suspend access to the extent needed to address it. Where reasonable, we will tell you beforehand, or otherwise without undue delay.

6

My Circle

The names you assign to people in your Circle stay on your device. Requests to our servers and to our AI providers carry a placeholder instead, so we do not know who is in your Circle. This is described in detail in the Privacy Policy.

You decide who you add and what you write about them. The obligations in section 5 apply to every profile you create.

7

Acceptable Use

You agree to comply with these Terms, to give us accurate information and keep it up to date, and to take reasonable care of your device and account.

You must not:

  • use the Services for anything other than accessing and using them as intended;
  • copy, modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works of the Services, or try to access the source code, except where the law permits it;
  • exploit the Services commercially or transfer them to third parties;
  • run penetration tests or anything liable to disrupt or deny the Service;
  • upload, generate, store or distribute unlawful content or content infringing the rights of others;
  • use the Services in a way that could damage the Company's reputation.
8

Prohibited Uses of the AI Features

You may not use the AI features, and may not let anyone else use them, to:

  • form part of an automated decision-making process with legal or similarly significant effects;
  • predict or categorise people by protected characteristics, including racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, age, gender, sexual orientation, disability, health status or criminal convictions;
  • submit images of people without their consent in order to create, analyse or categorise biometric identifiers;
  • detect, infer or assess anyone's emotions;
  • create or expand facial recognition databases;
  • deploy subliminal, manipulative or deceptive techniques that impair someone's ability to make an informed decision;
  • exploit vulnerabilities arising from age, disability or a specific social or economic situation;
  • create, upload, store, process or transmit content harmful to minors, including content related to child exploitation or abuse;
  • make or support decisions about anyone in hiring or employment, housing, insurance, credit, medical or psychological assessment, legal matters, education or law enforcement, or to conduct surveillance or background checks;
  • harass, stalk, threaten, defame or discriminate against anyone, or share Output about someone in a way that could harm, embarrass or discriminate against them.

For the avoidance of doubt: the intended use of the Services — submitting a photo of a person you have permission to photograph, in order to receive communication-related observations for your own reflection — is not a prohibited use. The restrictions above concern attributes inferred or categorised beyond the intended functionality. They do not apply to attributes you declare yourself, such as the form of address you select for a profile.

If we reasonably believe you have breached this section, we may take the measures set out in section 5.

9

Entertainment and No Reliance

Cibe is entertainment. The Output is generated by AI from visual patterns and communication signals, is not scientifically validated, and is a starting point for your own reflection — not a factual statement about any person. You agree not to use Output as the basis for decisions about anyone.

The Services do not provide psychological, medical, legal or other professional advice, and are not a substitute for it.

Because of how AI works, we do not warrant that Output is accurate, complete, unique or fit for your purpose. Review it before you act on it. Other users may receive similar or identical Output.

When you use the chat feature, you are interacting with an AI system, not with a person.

10

Profile Sharing

You may share selected profiles or invitation codes through the available sharing functions. When you do, you confirm that you have the permission of the person concerned, and you remain solely responsible for what you share. This confirmation is recorded in the same way.

You must not share profiles or Output in a way that could harm, embarrass or discriminate against the person described, and you must not share profiles of minors. Shared Output is generated for you and your individual situation; it is not intended for a general audience.

11

Quality Assurance and Personalisation

We analyse stored conversations automatically to find faults, measure the quality of the output and produce aggregate statistics about how the Services are used. No one at Intevion reads your conversations for this purpose, and the analysis runs on stored content in which names appear only as placeholders.

This rests on our legitimate interests. You may object at any time; see the Privacy Policy, which sets out the legal basis and how to exercise that right.

Personalisation of responses is separate, uses information stored on your device, and is unaffected by any objection to the analysis above.

12

Privacy

How we handle personal information is set out in the Privacy Policy. In short: photos pass through our servers to an AI provider to generate a text description and are never stored; the names you assign stay on your device; conversation history is stored with placeholders and deleted within seven days of you deleting your account.

13

Plans and Payment

Free plan

The free plan includes up to two new people added per day and up to five new Cibe answers per day.

Premium plan

The premium plan includes up to 1,000 Cibe answers and up to 100 new people per month, an ad-free experience, priority support and early access to new features. Current plans, limits and prices are shown in the App and may change.

Additional quota

If you reach a monthly limit, you can buy additional quota at the price shown in the App at the time of purchase.

Billing

Subscriptions and additional purchases are sold, processed and billed by the App Store you bought through, under that store's terms. We do not operate a web checkout and never receive your payment details.

Subscriptions renew automatically until cancelled. You manage and cancel your subscription in your App Store account settings; the App links you there from the Premium section. We cannot cancel or refund a store subscription on your behalf, because we have no access to it.

Prices shown include any applicable taxes and duties. We may offer trials or promotional plans on additional terms.

14

Intellectual Property

The Services and everything in them — software, technology, content, documentation, text, graphics, images, logos — belong to us or are licensed to us. Apart from the limited right of use granted in section 4, you receive no rights in them.

Your content

You keep the rights in your Customer Content. You grant us a royalty-free, non-exclusive, worldwide licence to store, process, transmit, translate and adapt it, but only as far as needed to provide the Services to you and to keep them working.

This licence lasts for the term of your contract and ends when the contract ends, subject only to the retention periods set out in the Privacy Policy. It does not survive deletion of your account.

15

Third-Party Services

The Services depend on third parties — app stores, AI providers, hosting, telecommunications networks and your own device. Interruptions or delays can arise from circumstances outside our control. We are not responsible for the content or operation of third-party websites the Services may link to.

16

Changes and Availability

We may provide updates, including security updates, needed to keep the Services working properly and securely. Where you need to install or accept an update, we will tell you it is available and what happens if you do not.

We may otherwise change or improve the Services for a valid reason — technical, operational, security, legal or regulatory requirements, preventing misuse, changes to third-party services, or improvements to functionality, security or usability — provided this causes you no additional cost.

We use reasonable efforts to keep the Services available, within the limits of current technology. Temporary restrictions can occur for maintenance, capacity or security reasons, or for events outside our reasonable control.

17

Disclaimers

We provide the Services with reasonable care and skill. We do not guarantee that they will be uninterrupted, error-free or always available, or that any particular feature or performance level will be maintained. We give no warranties beyond those expressly stated here.

Nothing in this section limits your mandatory statutory rights. If you are in the EU or EEA, see Part A; if you are elsewhere, see Part B.

18

Liability

Our liability is set out in the annex that applies to you — Part A for the EU and EEA, Part B elsewhere. Where an annex limits or excludes our liability, the same limits apply to our employees, representatives and subcontractors.

19

Indemnification

If a third party brings a claim against us because you submitted content you had no right to submit, or used the Services in breach of these Terms, you will hold us harmless from that claim and from reasonable costs of defending it, to the extent the claim is attributable to you.

If you are a Consumer, this applies only where you are at fault, and only to the extent permitted by the law that applies to you.

20

Termination

The contract for free use runs indefinitely, and either of us can end it at any time. You end it by deleting your account or by contacting us. We may end it, or deregister you, on at least 14 days' notice. Either of us may terminate for good cause without notice — for us, in particular where you breach these Terms, break the law or misuse the Services.

Paid subscriptions run for the period you selected and are managed through your App Store, as set out in section 13.

What happens then

Your right to use the Services ends immediately and you must stop using them. You lose access to the Services and to data stored in them, except where the law requires us to give you access to, or a copy of, certain data. Export anything you want to keep before you terminate.

Deleting your account also deletes our server-side data about you within seven days, as described in the Privacy Policy.

Survival

Provisions that by their nature are meant to outlast the contract — intellectual property, liability, indemnification, and the general and dispute-resolution provisions of the annex that applies to you — survive termination.

21

General

  • Entire agreement: these Terms and the Privacy Policy are the whole agreement between us about the Services.
  • Severability: if a provision is invalid or unenforceable, the rest stays in force.
  • No waiver: not enforcing a provision is not a waiver of it.
  • Assignment: you may not assign these Terms without our consent. We may assign them as part of a business transaction, provided this does not reduce your rights.
  • Force majeure: neither of us is liable for delay or failure caused by events beyond reasonable control, including acts of God, war, riot, power or telecommunications failures, fire, strikes, pandemics, floods and natural disasters.
  • Language: the governing language of these Terms is English. We may provide translations for convenience; they are not binding.
  • Changes: the version published here is the one in force. Purely formal changes, updated references and minor wording adjustments take effect without notice. For substantive changes, see the annex that applies to you.

Part A

Customers in the European Union and EEA

This part applies if you live in the EU or the EEA. If it applies to you, Part B does not — including its arbitration agreement, class action waiver and jury trial waiver.

A1

Governing law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a Consumer habitually resident in another country, this choice of law does not deprive you of the protection of the mandatory provisions of that country's law. Those provisions continue to apply alongside German law wherever they are more favourable to you.

A2

Jurisdiction

If you are a Consumer: there is no exclusive place of jurisdiction. You may bring proceedings against us either in the courts of your place of residence or in Germany. We may bring proceedings against you only in the courts of your place of residence.

If you are not a Consumer: the exclusive place of jurisdiction is Berlin, Germany.

A3

Your consumer rights

Nothing in these Terms limits your statutory consumer rights. Your rights under Sections 327 et seq. of the German Civil Code for digital products — including your rights where the Services are not supplied, or are defective in fact or in law — are unaffected.

A4

Right of withdrawal

As a Consumer you have a statutory right to withdraw from a contract for a paid plan within 14 days of concluding it, without giving reasons.

Because subscriptions are bought and billed through an App Store, withdrawal, cancellation and refund requests are submitted through that store, under its procedures. You will find the applicable process in the cancellation policy of the Apple App Store or Google Play.

If you have difficulty exercising your right of withdrawal through the store, contact us at ai (paste "at" for mails here) cibe.app and we will help.

A5

Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and where we have given a guarantee. Liability under the German Product Liability Act is unaffected.

We are also liable for breach of a material contractual obligation — an obligation whose fulfilment is essential to the proper performance of the contract and on which you may regularly rely. Where such an obligation is breached slightly negligently, our liability is limited to the damage foreseeable at the time the contract was concluded and typical for this kind of contract.

Any further liability is excluded.

A6

Changes to these Terms

We will tell you about substantive changes at least six weeks before they take effect, together with a summary of what is changing.

If you do not agree, you can delete your account. If you have not agreed by the end of the notice period, the changes do not take effect for you and the previous Terms continue to apply; in that case we may terminate the contract for cause within two weeks after the notice period ends.

A7

Price changes

We may notify you of a price increase at least 30 days before the end of the current subscription period. If you do not agree within those 30 days, the contract continues at the previous price, and we may terminate it within four weeks after that period ends. We will tell you about this consequence when we give notice.

Where the App Store operates its own price-change consent process, that process applies in addition.

A8

Dispute resolution

Before starting legal proceedings, both of us will try to settle the matter amicably. Write to ai (paste "at" for mails here) cibe.app.

We are generally willing, but not obliged, to take part in dispute resolution proceedings before a consumer arbitration board.

Part B

Customers outside the EU and EEA

This part applies if you live anywhere other than the EU or the EEA. If it applies to you, Part A does not.

This part contains a binding arbitration agreement and a class action waiver. They affect how disputes between you and us are resolved. Please read section B4 carefully, including the opt-out in B5.

B1

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules, except where the mandatory law of your place of residence applies.

B2

Disclaimers and liability

To the maximum extent permitted by law, the services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill. Our total liability arising out of or relating to these Terms or the Services will not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or fifty US dollars.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the above may not apply to you. Nothing here limits liability that cannot be limited by law.

B3

Informal resolution first

Before filing a claim, you agree to try to resolve the dispute informally by writing to ai (paste "at" for mails here) cibe.app with a short description of the problem and what you want. We will do the same. If the matter is not resolved within 60 days, either of us may proceed.

B4

Binding arbitration and class action waiver

If informal resolution fails, any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except where applicable law does not permit arbitration.

You and Intevion, Inc. waive the right to a jury trial and agree that claims will be brought only on an individual basis, and not as a plaintiff or class member in any class, consolidated or representative action, to the maximum extent permitted by law.

Either of us may instead bring an individual claim in small claims court if it qualifies. Either of us may also seek temporary or injunctive relief in court where necessary to protect intellectual property or confidential information, or to prevent irreparable harm.

B5

How to opt out of arbitration

You can reject the arbitration agreement and the class action waiver in B4. Send an email to ai (paste "at" for mails here) cibe.app with the subject "Arbitration opt-out", stating your name and the email address on your account, within 30 days of first accepting these Terms.

Opting out costs nothing, changes nothing else in these Terms, and has no effect on your account or your use of the Services.

B6

Subscriptions and cancellation

Subscriptions renew automatically at the price and interval shown at purchase until you cancel. You cancel in your App Store account settings; the App links you there from the Premium section. Cancelling stops future renewals and takes effect at the end of the current billing period. Refunds are handled by the store under its policies.

B7

Changes to these Terms

We will post substantive changes here and, where reasonable, notify you in the App or by email before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms. If you do not accept them, stop using the Services and delete your account.
